These terms outline the agreement between you, your team, and FABLES which includes our affiliates. They cover your use of content uploaded to fables.pro (the "WEBSITE") and our services. This includes publishing comics/graphic novels and the promotion of them. Any new features added will also be subject to these terms.
By sharing CONTENT through our Services, you confirm that you've read, understood, and agree to follow these Publisher Conditions and abide by all relevant laws and regulations. If you disagree with these conditions, please refrain from using the WEBSITE or Services. In case of any conflict between these Publisher Conditions and the standard FABLES Terms and Conditions, Privacy Statement, and/or Content Policy, these Publisher Conditions will take precedence.
The Publisher Service is a web-based platform where you can publish, promote, and share your content on the WEBSITE. It also gives you access to content from other USERS. Please note that the Service is provided as is, and we cannot guarantee uninterrupted or error-free use. Therefore, we are not responsible for the availability, timeliness, security, or reliability of the Service.
We maintain the right to enhance, pause, or discontinue the Service as needed, with or without prior notice, and without incurring any liability to anyone. Additionally, we may refine your CONTENT, such as titles and descriptions, if necessary to align with these Terms. Certain services for Administration Support may be subject to charges based on our designated pricing structure available on WEBSITE when active, which is subject to change without notice. Any alterations in pricing will be communicated by updating the Service on the WEBSITE. Please understand that we aim to ensure the smooth operation of the Service, and any adjustments or discontinuations are made with this goal in mind. If, unfortunately, your account is terminated due to a breach of these Terms, we regret to inform you that no refunds or unpaid earnings related to the breach will be provided.
You need to be at least eighteen (18) years old to use this Service. If you're under 18, you can only use the WEBSITE with a parent or guardian's permission. You must provide accurate information during registration and while using the Service. Falsifying a date of birth is strictly prohibited
It's your responsibility to keep your Service login information and password secure. Any activities on your account are your responsibility. FABLES won't be held responsible for any losses or damages for your failure to keep your account secure. We may refuse service or terminate anyone's service at any time without notice if they violate these or any other FABLES policies.
You confirm that: (a) all the information you provide to us for using the Services is accurate and up-to-date; and (b) you have the authority to agree to these Terms of Service and fulfill your obligations under them.
You agree to use the Service according to all relevant laws and regulations. You won't upload, promote, sell, or share any content that's abusive, harassing, threatening, defamatory, fraudulent, deceptive, offensive, or illegal. Also, you won't infringe on anyone else's intellectual property rights. Your uploads must follow the FABLES Content Policy, and you must use mature content tags as per the FABLES Terms of Service. If you violate any of these rules, we may immediately terminate your access. We reserve the right to monitor your content and remove anything we find inappropriate, but we're not obligated to do so nor are we responsible for such content.
You can choose to display ads on your CONTENT through FABLES' advertising partners. These partners are approved by FABLES to run ads on the WEBSITE. Any agreements made between you and the advertising partners are solely your responsibility, and FABLES isn't liable for them. You agree to protect FABLES from any liability or issues that may arise.
FABLES allows its advertising partners to place ads on your CONTENT page on the WEBSITE. You keep all the revenue from these ads. FABLES can change or remove any ads on your page at its discretion or if there are changes in ad policies.
If you don't want ads on your page, you can use the space to promote other content, as long as it follows the Terms of Service and as long as the Services allows it.
FABLES will run ads throughout the WEBSITE and alongside your CONTENT using the FABLES advertising Partners. The USER is not entitled to any of the revenue earned from those ad spots. If you see any advertisement that is inappropriate, please report them to our Community Liaison Officer at Jay (at) Fables (dot) pro.
It's up to you to figure out if you need to pay taxes on the money you receive from our advertising partners, and to make sure you collect, report, and pay the correct amount to the tax authority. FABLES isn't responsible for deciding if taxes apply to transactions or for handling any tax payments from our advertising partners to you.
According to the law, our advertising partners may report accounts with earnings over a certain amount and more than a specific amount of separate payments in a year to tax authorities, depending on your agreement with them or depending on the law.
FABLES won't provide tax documents to USERS and CREATORS. It's your responsibility to check the tax details with our advertising partners before using the ad service.
We shall own all personal data processed through the Service, following the FABLES privacy statement. We're not required to share customer data unless mandated by law.
We recognize that your design source files are proprietary and confidential. We'll keep them confidential and won't share them with anyone else, except in these cases: (i) if required by law, following the FABLES Privacy Statement; (ii) if related to the purposes outlined in the FABLES Privacy Statement; or (iii) if you give us explicit permission.
In addition to the rights mentioned in the FABLES Terms of Use, you allow us to use the images and content you've uploaded for our services. We may also ask for your permission to use your designs and/or content to market and promote the WEBSITE, such as in flyers, brochures, websites, and social media. You may refuse this request freely. If you agree, this permission extends to allowing us to share these rights with third parties, like a printing company for a brochure or social media representatives, for marketing purposes. If you remove your design and content from your publisher profile, you revoke all granted licenses under these Terms of Service except for the right to use images of your designs for marketing and promotional purposes for a reasonable period while we phase out existing materials.
FABLES and its affiliates or licensors own the copyright and other rights to the Service, including software, audio, video, text, and photos (excluding your content). Any rights not explicitly granted are reserved. You agree not to copy, modify, or create derivative works from the Service. You also agree not to use any automated tools to copy content from the Service. Our rights cover the Service itself and all associated software.
In addition to the terms referenced in the Terms of USE, these additional terms of Warranty and Liability apply to designs and content you upload to your publisher portal. As the owner of a design uploaded to the WEBSITE, you recognize that users accessing your content may have warranty rights under their local laws. Also, you are solely responsible for the specifications and performance of any content you upload to the WEBSITE.
These Terms of Service outline all our responsibilities and liabilities regarding the Service. Except as expressly stated in these terms or the FABLES Terms of Use, we don't provide any warranties or other binding terms related to the Service. Any implied warranties, conditions, or terms are explicitly excluded, including those regarding quality, fitness for purpose, and reasonable care and skill.
However, we won't limit or exclude our liability for: (i) death or personal injury caused by gross negligence, (ii) fraud, (iii) breaches of obligations under applicable national laws, or (iv) any liability that cannot be excluded by law.
We won't be liable for loss of income, profits, contracts, or data, or for any indirect, incidental, exemplary, special, punitive, or consequential damages, whether caused by negligence, breach of contract, or otherwise. Our maximum liability under these terms, whether in negligence or otherwise, won't exceed the fees you paid us for using the Services.
You may end your use of the Service or cancel these Terms of Service anytime by letting us know or by deleting your content. We can also stop the Service, end these Terms of Service, or suspend or close your account at any time and for any reason. If your account is terminated, it will be disabled, and you may lose access to your files or content, though some information may still be stored in our system for historical purposes.
These Terms of Service shall be governed by the laws of Alberta, Canada without regard to the conflicts of law principles thereof that would apply the law of any jurisdiction other than Alberta, Canada. Any and all disputes arising from these Terms of Service, including disputes relating to the validity thereof, and any disputes related to the use of the Service, shall be brought in the federal and provincial courts located Edmonton, Alberta, Canada.
We may update these Terms of Service periodically and will post any changes on our WEBSITE. We might also notify you through the service or by email. So, it's a good idea to check the WEBSITE regularly to stay informed about any updates. Any transactions you make will be governed by the Terms of Service in place at the time of the transaction. FABLES offers publishing and community management services on the WEBSITE to you, referred to as the USER, subject to the following terms and conditions (also known as Terms of Service or TOS). By using or visiting the WEBSITE, including all content available through the WEBSITE domain (including its sub-domains), you acknowledge that you have read, understood, and agree to be bound by these terms and conditions, as well as the terms of Fables' privacy notice provided on the WEBSITE. If you agree to these terms of service, please continue using the WEBSITE. If you disagree with any of these terms, please refrain from using the WEBSITE or contact a Fables representative for clarification.
The Terms of Service apply to all users of the WEBSITE, including those who contribute content (referred to as CREATORS). The WEBSITE may contain links to third-party websites not owned or controlled by FABLES. FABLES isn't responsible for the content or practices of these third-party websites and doesn't censor them. By using the WEBSITE, you release FABLES from any liability related to third-party websites or from the content published by Creators. We recommend reading the terms and conditions and privacy policy of any website you visit outside of the WEBSITE.
FABLES grants USERS and CREATORS permission to use the WEBSITE according to these Terms of Service, with the following conditions:
o You can only use the WEBSITE for personal, non-commercial purposes unless otherwise agreed upon in writing with FABLES.
o You can't copy or share any part of the WEBSITE without permission from FABLES, except for your own copyrighted material if you're the CREATOR.
o You can't change any part of the WEBSITE, except as needed to use it properly or as intended, and you must follow all the terms and conditions outlined here.
To access certain features, you need to create an account. You can't use another user's account without permission, and you must provide accurate information when creating your account. You're responsible for any activity on your account, so keep your password secure. If there's any unauthorized use, notify FABLES immediately. While FABLES isn't responsible for losses from unauthorized account use, however, you might be liable for FABLES' or others' losses if the loss is due to negligence on your part.
You agree not to use or launch any automated system, including without limitation, "robots," “AI,” "spiders," "offline readers," etc., that accesses the WEBSITE in a manner that is not representative of intended use, or in any attempt to harvest content from the WEBSITE. Notwithstanding the foregoing, FABLES permits the operators of public search engines to use spiders to copy materials from the WEBSITE for the sole purpose of creating publicly available searchable indices of the materials, but not caches or archives of such materials. FABLES reserves the right to revoke these exceptions either generally or in specific cases. You agree not to collect or harvest any personally identifiable information, including account names, from the WEBSITE, nor to use the communication system provided by the WEBSITE for any commercial solicitation purposes. You agree not to solicit, for commercial purposes, any USERS of the WEBSITE or CREATOR with respect to their User Submissions.
The content on the WEBSITE, excluding USER and CREATOR Submissions, is owned by or licensed to FABLES, and is protected by copyright and other intellectual property laws. FABLES CONTENT and USER CONTENT on the WEBSITE are provided AS IS for your personal use only and may not be used for any other purposes without written consent. FABLES reserves all rights not expressly granted. You agree not to use, copy, or distribute any CONTENT for commercial purposes other than as allowed here, including USER and CREATOR Submissions. You're granted a limited, revocable, and nonexclusive license to access and use the WEBSITE. You can't frame the WEBSITE without FABLES' consent. If you download or print a copy of the CONTENT for personal use, you must retain all copyright and other proprietary notices contained therein. You agree not to circumvent, disable, or otherwise interfere with security-related features of the WEBSITE or features that prevent or restrict the use or copying of any CONTENT or enforce limitations on the use of the WEBSITE or the CONTENT therein.
The WEBSITE may allow users to submit various types of electronic CONTENT, known as USER & CREATOR Submissions, which may be hosted, shared, and/or published at FABLES' discretion. FABLES doesn't guarantee confidentiality for any Submissions, whether they're published or not.
You're responsible for your own USER & CREATOR Submissions, including comments, pictures, statements, and copyrighted material. By submitting, you affirm that you have the necessary rights and permissions for FABLES to use the Submissions as outlined in these Terms of Service.
You grant FABLES a license to use, reproduce, distribute, and display your CONTENT on the WEBSITE. This license ends when you remove your CONTENT from the WEBSITE. You also acknowledge that FABLES may retain server copies of removed Submissions for historical purposes.
You hereby also agree to:
o Take responsibility for your Submissions, including any copyrighted material or third-party rights.
o Not post false or harmful material, solicitations, or impersonate others.
o Recognize that FABLES isn't responsible for Submissions' accuracy, safety, or intellectual property rights, and waive any legal claims against FABLES regarding them.
You're allowed to link to WEBSITE materials for personal, non-commercial use only, and FABLES can discontinue any aspect of the WEBSITE at any time.
With respect to posted CONTENT, the submitting USER & CREATOR retains ownership and copyrights of such CONTENT.
In connection with USER & CREATOR Submissions, you further agree that you will:
o Not publish falsehoods or misrepresentations that could damage FABLES and WEBSITE or any third party;
o Not submit material that is unlawful, obscene, defamatory, libelous, threatening, harassing, hateful, racially or ethnically offensive, or encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law, or is otherwise inappropriate;
o Not post advertisements or solicitations of business;
o Not to impersonate another person. FABLES does not endorse any USER or CREATOR Submission or any opinion, recommendation, or advice expressed therein, and FABLES expressly disclaims any, and all liability in connection with USER & CREATOR Submission. FABLES does not permit copyright infringing activities, and infringement of intellectual property rights on the WEBSITE, and FABLES will remove all CONTENT and USER & CREATOR Submissions if properly notified that such CONTENT infringes on another's intellectual property rights. FABLES reserves the right to remove CONTENT and USER & CREATOR Submissions without prior notice. FABLES will also terminate a USER's access to the WEBSITE if they are determined to be a repeat infringer. FABLES also reserves the right to decide whether CONTENT or a USER and/or CREATOR Submission is appropriate and complies with these Terms of Service for violations other than copyright infringement and violations of intellectual property laws, such as, but not limited to, obscene or defamatory material. FABLES may remove such USER and CREATOR Submission and CONTENT and/or terminate a USER's access for uploading such material in violation of these Terms of Service at any time, without prior notice and at its sole discretion.
o The WEBSITE may display CONTENT that is rated for a mature audience. Therefore, USERS may not lie about their age and date of birth to prevent explicit CONTENT from being distributed to minors. USER and CREATOR Submissions that have mature content must flag the CONTENT as mature without exception or risk CONTENT removal and/or account suspension.
In particular, if you are a copyright owner or an agent thereof and believe that any USER and/or CREATOR Submission or other CONTENT infringes upon your copyrights, you may submit a notification by providing our Copyright Agent with the following information in writing;
o A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
o Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
o Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled and information reasonably sufficient to permit the service provider to locate the material.
o Information reasonably sufficient to permit FABLES to contact you, such as an address, telephone number, and, if available, an electronic mail;
o A statement that you have a good faith belief that use of the material in the manner complained of is not authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

You acknowledge that if you fail to comply with all of the requirements of this Section your notice may not be valid. You may also contact this address for any other feedback, comments, requests for technical support, and other communications.
o You understand that when using the WEBSITE, you will be exposed to USER & CREATOR Submissions and CONTENT from a variety of sources and that FABLES is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such USER & CREATOR Submissions and/or CONTENT. You further understand and acknowledge that you may be exposed to USER & CREATOR Submissions that are inaccurate, offensive, indecent, or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against FABLES with respect thereto, and agree to indemnify and hold FABLES, its Owners/Operators, affiliates, and/or licensors, harmless to the fullest extent allowed by law regarding all matters related to your use of the WEBSITE.
o FABLES permits you to link to materials on the WEBSITE for personal, non-commercial purposes only. In addition, FABLES reserves the right to discontinue any aspect of the WEBSITE at any time.
You agree that using the WEBSITE is at your own risk. FABLES and its officers, directors, employees, and agents disclaim all warranties, whether express or implied, regarding the WEBSITE and your use of it. FABLES makes no guarantees about the accuracy or completeness of the WEBSITE content or linked sites, and is not liable for any errors, personal injury, unauthorized access, interruptions, viruses, or any loss or damage resulting from using the WEBSITE. FABLES doesn't endorse or take responsibility for any third-party products or services advertised on the WEBSITE or linked sites. You should use caution and judgment when making transactions or decisions based on information from the WEBSITE.
FABLES, its officers, directors, employees, and agents are not liable to you for any damages, including lost profits, resulting from errors in CONTENT, personal injury, unauthorized access to secure servers, interruptions in transmission, business interruptions, or any loss or damage from using WEBSITE content. This applies regardless of whether FABLES was advised of the possibility of such damages and even if events are beyond FABLES' control. FABLES' maximum liability is limited to $100. The WEBSITE is operated from Canada, and FABLES makes no guarantees that it is suitable for use in other locations. Users accessing the WEBSITE from elsewhere are responsible for compliance with local laws.
You agree to protect, defend, and indemnify FABLES, its parent company, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses, including attorney's fees, resulting from:
o Your use of the WEBSITE;
o Violation of any of these Terms of Service;
o Infringement of any third-party rights, such as copyright or privacy;
o Claims that your USER and/or CREATOR Submission or CONTENT harmed a third party. This obligation remains even after these Terms of Service end and you stop using the WEBSITE.
You confirm that you are either 18 years old or older, an emancipated minor, or have obtained legal consent from your parent or guardian. You affirm that you are capable of understanding and agreeing to the terms, conditions, and responsibilities outlined in these Terms of Service, and will follow them accordingly. Additionally, you confirm that you are at least 13 years old, as the WEBSITE is not meant for children under this age. If you are under 13, please refrain from using the WEBSITE.
However, please note that the WEBSITE includes materials not suitable for individuals under 18, or the legal age in their jurisdiction ("Minors"). FABLES is not responsible for any consequences if Minors access such materials, even if they are marked as inappropriate in any way. If a Minor accesses mature CONTENT, their access to the WEBSITE may be suspended without prior notice, at FABLES' discretion.
These Terms of Service, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by FABLES without restrictions.
You agree that:
o The WEBSITE operates under the laws of Alberta and New Brunswick, Canada.
o The WEBSITE is considered passive and does not subject FABLES to jurisdiction outside of Alberta and New Brunswick.
o Any disputes between you and FABLES regarding the WEBSITE will be resolved through confidential arbitration in Edmonton, Alberta, following the rules of the Canadian Arbitration Association.
o FABLES may seek legal action in Alberta if there is a violation of intellectual property rights.
o These Terms of Service, along with the Privacy Notice and other legal notices on the WEBSITE, constitute the entire agreement between you and FABLES.
o If any part of these Terms of Service is found invalid, the remaining parts will still apply.
o FABLES can update these Terms of Service at any time without notice, and your continued use of the WEBSITE indicates your acceptance of the changes.
o Any legal actions related to the WEBSITE must be initiated within one year of the issue arising.
To use the FABLES service:
o You must be at least 18 years old or the legal age in your area. If you're under 18, you can join with a parent or guardian's permission.
o You can only use the service for personal, non-commercial purposes.
o You're granted limited access to view content on the service, but you don't own any rights to it unless it's your own copyright material.
o You agree not to use the service for public performances without written permission.

o You understand that the FABLES software is for authorized viewing only, and you may receive updates automatically.
The USER who created the FABLES account has control over it and any FABLES-ready devices used to access the service. The USER is responsible for all activity on the account. To keep the account secure, the USER should control access to the devices and not share their password. It's important to keep account information accurate and updated. We may suspend or terminate your account to prevent fraud, but we're not required to provide credit for any holds placed on the account.
